Dangerous Moron Dismisses CA 50 Law Suit

Judge Yuri Hofmann, you unspeakable shithead, since when does a Speaker of the House have the Constitutional authority to swear a candidate into office BEFORE THE ELECTION IS OVER?

Hofmann’s idiotic justifications for dismissing this law suit filed by CA 50 voters are apparently based upon his feeble interpretation of Article 1, Section 5 of the United States Constitution, which decrees that, “Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members.”

As Brad Blog notes, Paul Lehto, the plaintiff’s attorney, pointed out the irrelevance of Hofmann’s reliance on Article 1, Section 5 in a statement, noting that, “the election was not finished when exclusive power was transferred to the House by the swearing-in on June 13th, and it terminated the democratic processes that we all expect to operate to their conclusion. This denied due process to the voters, denied equal protection of the law to the 50th Congressional District and, in fact, denies democracy to us all.”

In the aftermath of Hofmann tossing the voting rights of Americans into a San Diego dumpster, what is to prevent the RePugs from Diebolding their way to “wins” in enough races to keep control of the House and Senate, and then swearing their “winners” into office before paper trail evidence refuting their “wins” can be gathered, and before recounts can be conducted?

What will you do then, Democratic leadership? What will you do, DNC? What will you do, DCCC and DSCC? Write a strongly worded letter to Ken Mehlman?

The RePugs brazenly violated voting machine security laws in CA 50, flew in RNC operatives, who stuffed ballot boxes with 10,000 absentee ballot “votes” for Bilbray on the weekend before the election, and then flew that son of a bitch to DC where that smirking fat ass Hastert hastily swore him into office so they could obstruct any pending legal action by claiming a specious Article 1, Section 5 defense.

Bilbray “won” in CA 50 because of Category 5 electoral fraud, yet of equal concern is the fact that neither the DNC, the DCCC, nor House or Senate Democrats have done a damn thing about it. This is very disturbing, considering the fact that millions of progressive activists are devoting unprecedented time, energy, and money to support Democratic candidates so we can restore democracy to America and hold this criminal Republican administration and Congress accountable for their crimes.

In the past, new congressmen and senators have been sworn into office in January, but that was before the United States of America was turned into the United States of Orwell by Republican fascists and their corporate media whores. I hope we don’t see a flurry of early swearing-in ceremonies for Republican “winners” in the immediate aftermath of Election Day, but in the wake of this CA 50 outrage, it seems very likely.

Well, Reed, one could not quibble with one word of yours -- it's all true! That is the upside of it -- on the downside of it, there are still too many Americans who "just don't get it." I hope your article will, at least, enlighten a few of them -- Americans, that is!

There have been several reports in recent days about drafts of the Bush Administration’s proposed amendments to the War Crimes Act. Now, Slate has published a version of those amendments that reportedly was "sent to Congress" last week.

Currently, the federal War Crimes Act provides for criminal sanctions (up to life imprisonment, or even death in extreme cases) for all violations of Common Article 3 of the Geneva Conventions.

As expected, the RePugs are smearing Judge Anna Diggs Taylor for her court ruling to shut down illegal NSA spying. They can't smear the Constitution itself, so they are smearing everyone who defends it. Fortunately, 2 out of every 3 Americans finally realize that, and a Democratic Congress will deal with these RePug criminals in 2007.

Specter's reeking bill to "legalize" BushCo spying will be moving through the Senate the first week of September. Call your senators! Then call them again!
